In the event of disagreements, the parties undertake to find an amicable solution. Suitable evidence can be:\n\u003cul\u003e\n\u003cli\u003ePOS transaction logs with clear identification of the place and time of purchase.\u003c\/li\u003e\n\u003cli\u003eProof of payment (e.g. receipts, bank transfers) proving that the purchase was made directly via the PU's POS.\u003c\/li\u003e\n\u003cli\u003eIf applicable, customer communications or orders proving that the transaction was initiated independently of EDV-Guru.\u003c\/li\u003e\n\u003c\/ul\u003e\n\u003c\/li\u003e\n\u003c\/ul\u003e\n\u003c\/li\u003e\n\u003cli\u003e\n\u003cp\u003e\u003cstrong\u003eException if prior arrangement by EDV-Guru\u003c\/strong\u003e\u003c\/p\u003e\n\u003cul\u003e\n\u003cli\u003eCustomers who were initially referred via the EDV-Guru platform but later purchase at the PU's POS remain classified as customers referred by EDV-Guru. This applies regardless of whether the purchase was made on site.\u003c\/li\u003e\n\u003c\/ul\u003e\n\u003c\/li\u003e\n\u003c\/ol\u003e\n\u003c\/li\u003e\n\u003c\/ol\u003e\n\u003chr\u003e\n\u003ch3\u003e6. Disclaimer and Limitations of Liability\u003c\/h3\u003e\n\u003cp\u003eEDV-Guru is not liable for transactions, their conclusion or non-conclusion between users and the PU, or their consequences. EDV-Guru makes no guarantee regarding the quality, suitability or creditworthiness of a user and is not liable for the quality or suitability of the PU's service.\u003c\/p\u003e\n\u003cp\u003e\u003cstrong\u003eDisclaimer\u003c\/strong\u003e: EDV-Guru is only liable to the PU for intentional and grossly negligent violations of contractual obligations. Liability for slight negligence is excluded. A detailed statement of transactions and retained fees is provided to the user on a monthly basis.\u003c\/p\u003e\n\u003cp\u003e(4) The payment is made to the business account stored by the user. The user is responsible for providing current and correct account details to avoid delays in withdrawals.\u003c\/p\u003e\n\u003ch4\u003e\u003cstrong\u003e§5 Liability and warranty\u003c\/strong\u003e\u003c\/h4\u003e\n\u003cp\u003e(1) The provider assumes no liability for damages resulting from improper use of the software by the user.\u003cbr\u003e(2) The provider guarantees compliance with legal requirements within the scope of the software functionality, but is not liable for legal changes that require adjustments.\u003cbr\u003e(3) In the event of failures or malfunctions in the software, the provider undertakes to remedy these within a reasonable period of time.\u003c\/p\u003e\n\u003ch4\u003e\u003cstrong\u003e§6 Contract duration and termination\u003c\/strong\u003e\u003c\/h4\u003e\n\u003cp\u003e(1) The contract is concluded for an indefinite period of time.\u003cbr\u003e(2) Both parties can terminate the contract with a notice period of \u003cstrong\u003e3 months\u003c\/strong\u003e cancel at the end of the month.
